• "Customer Client" means any of Customer's leads, members, former members or other individuals or businesses with whom Customer interacts (such as by engaging in marketing activities or scheduling appointments) using the Services.


• "Other Information" is any information that does not reveal your specific identity or does not directly relate to an individual, such as Service usage data.


• "Personal Information" is information that identifies you as an individual or relates to an identifiable person, such as name, postal address, telephone number, email address, credit card number, and social media account ID. It does not include strings of code such as browser cookie IDs.


• "Services" means the Software as A Service, Website and Apps.


• Sometimes, we use the term "information" in this Privacy Policy, which may refer to either Personal Information or Other Information.

II. Types Of Personal Information We Collect

• Just browsing? We do not require you to affirmatively provide any Personal Information just to look at the publicly accessible pages of the Services. However, when you visit our Website or use our Apps, our servers automatically log your Internet Protocol (IP) address which is a number automatically assigned to your computer whenever you access the Internet.


• Customer Information. When a Customer creates an Account, we may collect the following Personal Information: your company name, address, phone number, email, credit card information, tax identification number, and other information about your business, as well as names and email addresses of Affiliates and Authorized Users for your Account.


• Customer Client Information. We also collect Personal Information about Customer Clients when Customer Clients provide their details to a Customer, such as when they initiate a transaction or otherwise interact with a Customer, such as to book an appointment.


• From other sources. In addition to the information we collect from you through the Services, we may receive information about you from other sources, such as public databases, strategic and joint marketing partners, as well as from other third parties. We may also collect other Personal Information through the Services at the direction of our Customers.


• Why we need it. We need to collect Personal Information in order to provide the requested Services to you. If you do not provide or enable us to collect the necessary information, we may not be able to provide the Services. If you disclose any Personal Information relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

III. How We Use The Information We Collect

We may use your Personal Information for legitimate business purposes:

• Create and manage your Account;
• Offer and provide products, services and information to you, including newsletters and information relating to events which may be of interest to you;
• Permit you to participate in forums, and discussion groups;
• Display Content on our Site, such as articles and informational videos related to your business;

• Communicate with your Customer Clients on your behalf to assist in the running of your business;
• Process claims we receive in connection with our Services;
• Operate, evaluate and improve our business (including developing new products and services; managing our communications; analyzing and enhancing our products and Services; and
• Perform data analyses and other processing (including market and consumer research, trend analysis, anonymization).
• We may also provide access to your Personal Information when legally required to do so, to cooperate with police investigations or other legal proceedings, to protect against misuse or unauthorized use of our Services, to limit our legal liability and protect our rights or to protect the rights, property or safety of users of the Services or the public. In those instances, the information is provided only for that purpose.

IV. How We Disclose The Information We Collect

We may disclose your Personal Information:

• To our Affiliates for the purposes described in this Privacy Policy.
• To third parties at Customer's request, such as Customer Relationship Management (CRM) software or applications used by Customer.
• To our strategic partners and third-party service providers who provide services such as website hosting, data analysis, payment processing services, order fulfillment, information technology and related infrastructure provision, customer service, email delivery, credit card processing, auditing and other similar services.
• To our Customers if you are a Customer Client and are using the Services to interact with that Customer. Please contact the Customer you interact with directly for more information on that Customer's privacy practices.
• To third parties to permit them (or their own customers) to send you marketing communications, consistent with your choices.
• To third-party sponsors of sweepstakes, contests and similar promotions, consistent with your choices.
• At some point in the future, we may allow you to access message boards. In that event, your information may be made available through message boards, chat, profile pages and blogs and other services to which you are able to post information and materials.
• To business partners in the context of a corporate transaction. If DojoFlo is involved in a sale or business transaction (e.g., merger or acquisition), DojoFlo will retain a legitimate interest in disclosing or transferring your Personal Information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings). Such third parties may include, for example, an acquiring or target entity and its advisors.
• Please note that we may use and disclose Other Information for any purpose, except where we are required to do otherwise under applicable law.
• If we are required to treat Other Information as Personal Information under applicable law, then we may use it for all the purposes for which we use and disclose Personal Information. In some instances, we may combine Other Information with Personal Information. If we combine any Other Information with Personal Information, we will treat the combined information as Personal Information.

V. How You Can Opt Out Of Receiving Information From Us

We give you many choices regarding our use and disclosure of your Personal Information for marketing purposes. (Please note that EU residents may have different options described below). You may opt-out from:

• Receiving electronic communications from us. If you no longer want to receive marketing-related emails or mobile text messages from us on a going-forward basis, you may opt-out of receiving these marketing-related emails or mobile text messages by sending a request for list removal to unsubscribe@dojoflo.com or changing your preferences in your Account. If you have provided your information to DojoFlo, and opt-out, DojoFlo will put in place processes to honor your request. This may entail keeping some information for the purpose of remembering that you have opted-out.


• Our sharing of your Personal Information with unaffiliated third parties for their (or their customers') direct marketing purposes. If you would prefer that we do not share your Personal Information on a going-forward basis with unaffiliated third parties for their direct marketing purposes, you may opt-out of this sharing by emailing unsubscribe@dojoflo.com from the email that you have signed up or used in receiving the Services.
  
  We will try to comply with your request(s) as soon as reasonably practicable.


• Administrative Correspondence. Please also note that even if you do opt-out of receiving marketing-related emails from us, we may still send you messages for administrative or other purposes directly relating to your use of the Services, and you cannot opt-out from receiving those messages.


• Customer Correspondence. If you are a Customer Client and no longer wish to be contacted by our Customer, please contact the Customer directly.

VI. Cookies And Similar Tracking Technologies

• Cookies. A cookie is a piece of data stored on the user's computer tied to information about the user. We may use cookies for a number of purposes, such as tracking usage patterns or matching the most relevant content to your particular needs (such as previously disclosed interests or geographies). We will not use cookies to retrieve information from your computer that was not originally sent by us to you in a cookie.
  
  You can, of course, disable cookies on your computer by indicating this in the preferences or options menus in your browser. However, it is possible that some parts of the Service will not operate correctly if you disable cookies. • Web Beacons. However, in general, any electronic image viewed as part of a web page, including an advertisement, can act as a web beacon. web beacons typically collect the URL of the page the web beacon comes from, the type of browser requesting the web beacon, the IP address of the computer that the web beacon is sent to and the time the web beacon was viewed. web beacons can also be linked to personally identifiable information, but we do not link information gathered through web beacons to personally identifiable information. We aggregate all information we collect through web beacons and we do not use web beacons to track any individuals' use of the Service. DojoFlo does not have control over web beacons used by third parties and does not have access to whatever information they may collect.


• Use of Cookie Data. We may use the data collected through cookies, log file, device identifiers, location data and clear gifs information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information, including advertising; (c) provide and monitor the effectiveness of the Service; (d) monitor aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on our Services; (e) diagnose or fix technology problems; and (f) otherwise to plan for and enhance the Service.

Protecting children's privacy is important to us. For that reason, no part of our Services are targeted to attract anyone under 13.

However, we realize that our Customers operate businesses which may collect personal information relating to Customer Clients who are children in connection with their business activities. Our Customers are responsible for ensuring that verifiable parental consent has been obtained for the collection and use of the children's personal information as well as complying with the Children's Online Privacy Protection Act (COPPA) and any other relevant legislation.

We will promptly comply with any verified parental request to delete the personal information held about a child and to cease providing any communication to a child.

VIII. Sensitive Information

We ask that you not send us, and you not disclose, any sensitive Personal Information (e.g. information related to racial or ethnic origin, political opinions, religion or other beliefs, biometrics or genetic characteristics, trade union membership or criminal background) on or through the Services or otherwise to us, except where explicitly requested by a Customer or consented to by you. Our Customers are responsible for ensuring that the collection and use of sensitive information is done in compliance with applicable law, including the Health Insurance Portability and Accountability Act of 1996 or HIPAA.

IX. Data Security

We appreciate the importance of maintaining the security and accuracy of personally identifiable information we collect and we use industry standard measures to protect the Services and any data collected or used for the Services. However, no data transmission over the Internet can be guaranteed to be completely secure. Accordingly, we cannot ensure or warrant the security of any Information you transmit to us, and you do so at your own risk.

X. Consent To Transfer

The Services are operated and DojoFlo is located in the United States. If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By using and/or participating in our Servicesand/or providing us with your information, you agree and acknowledge and consent to the collection, maintenance, processing and transfer of such information in and to the United States and other countries and territories. These other jurisdictions may have different privacy laws from your home jurisdiction and provide different levels of protection of personal information. DojoFlo does have processes and procedures in place to provide adequate levels of protection to protect the transfer of data from the European Union. You agree that the terms of this Privacy Policy will apply and you consent to the transmission and processing of your personal information in any jurisdiction.

If you are a resident of the European Union or European Economic Area, you have the right to access, rectify, download or erase your information, as well as the right to restrict and object to certain processing of your information. You have the right to access your personal data and, if necessary, have it amended or deleted or restricted You have the right to object to the processing of your personal data in certain circumstances where we have based our right to process on our legitimate interests explained above. You have the right to revoke your consent in those instances where you have previously provided your consent. You may have the right to access and take your personal information or to port it to another site. This right is not absolute and may not apply to the services provided by us. California residents who provide personal information in obtaining products or services for personal, family or household use are entitled to request and obtain from us, once per calendar year, information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year. We will send you a reply e-mail containing the requested information. Not all information sharing is covered by the California "Shine the Light" requirements and only information on covered sharing will be included in our response.

California Do Not Track (DNT): Because there is currently no industry or legal standard for recognizing or honoring DNT, we do not currently respond to DNT signals.

The Services may contain links to other sites. Please be aware that DojoFlo is not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every website that collects personally identifiable information.
